These Terms (hereinafter ‘Terms’) are a legally binding contract between you (hereinafter ‘User’) and ChessScanner (hereinafter ‘Provider’) for the use of the chess tournament management website (hereinafter ‘Website’). By registering and using the Website, you agree to be bound by the terms of these Terms.
1. Grant of licence
The Provider grants the User a limited, non-exclusive, non-transferable and revocable licence to use the Website for the administration of chess tournaments in accordance with the terms of these Terms.
2. Conditions of use
2.1 Registration
- In order to use the Website, the User must register and create a user account.
- The User is responsible for the confidentiality of his/her access data and may not disclose it to third parties.
2.2 Use of the functions
- The User may use the Website exclusively for the organisation and administration of chess tournaments.
- The entry and publication of content (e.g. participant data, tournament information, uploaded files) is the sole responsibility of the user.
3. Obligations of the User
3.1 Use in compliance with the law
The User undertakes not to use the Website for illegal purposes or in a manner that violates applicable law.
3.2 Entry of data
- The User is responsible for ensuring that the data entered is correct and does not infringe the rights of third parties (e.g. data protection rights, copyrights).
- Sensitive or personal data of third parties may only be entered with their express consent.
3.3 Publications
- Tournaments that the User marks as ‘visible’ are publicly visible to other Users and visitors to the Website. The User is responsible for not publishing any confidential or sensitive information.
4. Payments and Billing
- Orders are handled via Paddle.com
- Payments are due immediately
- Tokens are activated once payment succeeds
- Prices include applicable taxes
- Refunds follow the Refund Policy
5. Token System
- Tokens must be bought in advance
- Each scan consumes one token
- Tokens are non-transferable between accounts
- Unused tokens do not expire
6. Refunds
Refunds are handled according to the Refund Policy. In summary:
- You can request a refund within 14 days if no tokens have been used
- Refunds may also be granted at our discretion for valid complaints
7. Intellectual property
- All rights to the Website, including design, source code and content, remain the property of the Provider.
- Users may not reproduce, modify, distribute or otherwise use the content of the Website unless expressly authorised by the Provider.
8. Liability
8.1 Liability of the Provider
- The Provider shall not be liable for damages arising from the use or inability to use the Website, unless caused by gross negligence or intent on the part of the Provider.
- The Provider accepts no liability for the availability, accuracy or security of the Website.
8.2 Liability of the User
The User shall be liable for all damage caused by unlawful use of the Website or breach of this EULA.
9. Termination of use
- The Provider reserves the right to revoke the licence and block a User’s user account if the User breaches the terms of this EULA.
- The User can delete his user account at any time and stop using the Website.
10. Changes to this EULA
The Provider reserves the right to amend this EULA if necessary. The User will be informed of any significant changes by e-mail or by a notice on the Website. Continued use of the Website after the changes have come into effect shall be deemed to constitute acceptance of the amended EULA.
